Dear Mr. Manns,
I am very concerned about what appears to be the imminent public offering of Ascendant Copper Corporation on the Toronto Stock Exchange by Ascendant Holdings Ltd. (AHH.BH-Bermuda). My information is based upon a news release dated October 13, out of Hamilton, Bermuda ( http://www.bsx.com/cgi-win/bermuda-inc.exe/bsx-read-news=READ=1097699749 Though the news release does not specifically mention the Toronto Stock Exchange, I have reasons to believe Ascendant Exploration will try to list it there.
It is important to make evident that Ascendant Exploration has not been a reasonable corporate neighbor in the Intag region of Ecuador. On the contrary, Ascendant Exploration’s presence in this area has led to illegal behavior, including numerous death threats against community members who are opposed to its presence. In fact, June 2004, Ascendant paid agents in their attempt to illegally occupy land belonging to the Junin community (site of one of the proposed Ascendant copper project). Their unlawful behavior was halted by community members from Junín. However their continued harassment and maneuverings have created profound divisions between, and within communities and families. This must stop immediately. The violence recently escalated, and three local activists were assaulted on November 13th by armed bodyguards for taking a photograph in a public meeting arranged by Ascendant Exploration. These actions severely contradict the Ascendant Holding Ltd. stated mission, as described on their web page http://www.ascendantexploration.com/overview.html)
Furthermore, Ascendant has failed to abide by Ecuadorian law, Article 88 of the Constitution, which states that there must be due consultation with communities prior to project development. Clearly Ascendant is acting outside of the law. This is the basis of the lawsuit being prepared on behalf of the community of Junín ,which will be soon presented before the Inter-American Human Rights Commission, in Washington D.C.
As a result of the company’s aggressive behavior and lack of respect for Ecuadorian law, the proposed mine has galvanized a growing local and international opposition to the mining project. This opposition includes every community within the mining concession, in addition to the County government of Cotacachi, where the Junín concession is situated. As just one example of the official opposition, Mayor Auki Tituaña has presented a constitutional injunction against the mining project.
Please be advised that many people are concerned and vigilant as to proceedings between Ascendant and the TSE. Unethical dealings are not good business practices.
For all the above reasons, I respectfully request that the Toronto Stock Exchange undertake a full investigation into Ascendant Exploration’s activities in Intag, Ecuador before making a decision whether to list Ascendant Copper Corporation on its exchange.
